Are you in favor of amending the constitution to provide that municipalities shall have home rule authority to exercise such powers and perform such functions pertaining to its government and affairs which are not permitted by the state constitution, state statute, or common law, and that the state shall retain its right of preemption over municipal powers and functions? Upon passage of this question the first part of the New Hampshire Constitution will be amended by inserting after article 39 the following new article:
[Art.] 40 [Home Rule Authority Granted.] A municipality may exercise such powers and perform such functions pertaining to its government and affairs which are not prohibited by the state constitution, state statute, or common law. Nothing in this article shall be construed to alter or limit in any way the state's right of preemption over municipal poweers and functions.
